    A.R.S. §11-1606 Application Process Notice

    Under A.R.S. §11-1606 Pima County is required to give you the following information when you apply for a Modification of Setback Requirements (MSR):

    The following steps are required to obtain a Modification of Setback Requirements:

     

    • Provide a complete “Modification of Setback Requirements Application”
    • Provide all information required in “What is required for submittal of a MSR request” section of the Modification of Setback Requirements - MSR Checklist.
    • Successfully complete (one of the two below paragraphs): 

     The notification process of all property owners adjacent to the applicant’s property or within one hundred feet of the applicant’s property but separated by a public or private road or private common area. Staff will notify all property owners and provide 15 days for a noticed property owner to provide a written protest.

    Provide the signatures for all property owners adjacent to the applicant’s property or within one hundred feet of the applicant’s property but separated by a public or private road or private common area. If some of the signatures are provided, staff will notice other property owners that the applicant or property owner has not provided.

    • Apply for and receive approval of the secondary dwelling mobile home permit.

    Applicable licensing time frames: 10 days for Administrative completeness review and 30 additional days for substantive review.

    Under A.R.S. §11-1609, you may request that the County clarify its interpretation of the zoning code. You may submit a written request that states: (1) Your name and address;(2) The section of the zoning code requiring clarification; (3) Any facts relevant to the requested ruling (4) Your proposed interpretation of the applicable section;

    You may request clarification or interpretations by the Deputy Chief Zoning Inspector. Written interpretations are subject to a fee per adopted schedule posted on our web site. If you disagree with the Deputy Chief Zoning Inspectors interpretation, you may appeal the written response to the Pima County Board of Adjustments in accordance with Section 18.93.060 of the Pima County Zoning Code.

    A copy of this notice shall be provided upon request.
